
An Oregon man has filed a lawsuit against Hwy 99 Cannabis Co. and Quantum Alchemy, claiming a defective cannabis vape pen exploded while he was using it, causing severe injuries and property damage.
The plaintiff, Gustavo Mendes, alleged that the device was defectively designed and the explosion resulted in burns to his eyes, torso, and groin area, OregonLive reported.
The incident occurred while Mendes was completely unclothed in his bathroom, the outlet pointed out. He was taking puffs from the weed vape pen when he felt it overheating. The device suddenly exploded, causing him extensive injuries.
The lawsuit, filed in Lane County Circuit Court, seeks compensation for medical expenses, pain and suffering, and property damage. Mendes claims the incident caused $20,000 in bathroom damage, including destruction of the floor and countertop.
The case adds to a growing number of lawsuits over vape pen and e-cigarette explosions, which have raised concerns over product safety. Previous cases have resulted in significant legal settlements, including a Missouri man who won a $2.3 million lawsuit after being injured by an exploding vape.
With vaping’s popularity on the rise, calls for stricter regulations and product safety testing continue to increase.
